Terms of Service

These Terms of Service ("Terms") govern your use of hiringmath.com (the "Service"), operated by HiringMath. By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

The Service

HiringMath provides free, informational calculators and written content about the cost of hiring in the United States, including employer payroll taxes, the W-2 versus 1099 decision, and worker-classification considerations. No account is required and the calculators run in your browser.

Not professional advice

HiringMath produces estimates for general planning only. It is not tax, legal, accounting, financial, or HR advice, and it does not create any professional or advisory relationship. Tax law, unemployment-insurance rates, workers' compensation classifications, benefit costs, and worker-classification rules are complex, vary by situation, and change over time. Before making hiring, classification, payroll, or tax decisions, consult a qualified professional such as a licensed CPA, tax advisor, or employment attorney.

We draw our figures from public sources (including IRS Publication 15, the U.S. Department of Labor, and state unemployment agencies) and describe our approach on the methodology page, but we do not warrant that any figure is accurate, complete, current, or applicable to your circumstances.

No warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and accuracy, to the maximum extent permitted by law.

Limitation of liability

To the extent permitted by applicable law, HiringMath is not liable for any indirect, incidental, or consequential loss, or for any decision made or action taken in reliance on the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intent or gross negligence, for injury to life, body, or health, or under mandatory consumer-protection or product-liability law. Your statutory rights as a consumer are not affected.

Intellectual property

The site, its design, text, and software are owned by HiringMath and protected by intellectual-property law. Two exceptions are offered openly:

  • The state payroll-tax dataset on the employer payroll tax by state page is published under the Creative Commons Attribution 4.0 (CC BY 4.0) license; you may reuse it with attribution to HiringMath.
  • You may embed our calculator widget on your own site using the provided snippet, which includes attribution back to HiringMath. Do not remove that attribution.

Acceptable use

Please use the Service lawfully. Do not attempt to disrupt or overload it, misrepresent its output as professional advice to third parties, or scrape it in a way that harms its operation. We may suspend access that threatens the Service or other users.

Third-party links and affiliates

The Service may link to third-party sites and may contain advertising or affiliate links, which can earn us a commission at no extra cost to you. We are not responsible for third-party sites or services, and a link is not an endorsement.

Changes

We may update these Terms as the Service or the law changes. We will revise the effective date above when we do. Continued use after changes means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you also keep the mandatory protections of the law of your country of residence.
